As per Saudi Authority for Intellectual Property (SAIP)
If you’re preparing to register a trademark in Saudi Arabia, it’s essential to understand the required documentation to ensure smooth and compliant processing. Below is a detailed overview of the current requirements:
1. Trademark Image
A clear image of the trademark must be provided.
Image specifications: The dimensions must be either 1:1 or 2:1.
Image quality: The resolution should be no less than 300 pixels and no more than 1200 pixels.
Note: The image must not include symbols such as ™ (TM), ® (Registered), or © (Copyright) within the design.
2. Translation of Foreign Words
If your trademark contains foreign language expressions, a certified Arabic translation and pronunciation guide is required. This service is typically handled by your trademark agent in Saudi Arabia, who ensures the translation complies with SAIP’s standards.
3. Explanation of Arabic Terms (If Obscure)
If the trademark includes Arabic words that are not commonly understood by the general public, an explanation of their meaning must be submitted.
4. Domain Name Ownership (If Applicable)
If your trademark image includes a domain name (e.g., .com), proof of domain ownership must be submitted. This should confirm that the domain is registered in the name of the trademark applicant.
5. Verification of Dates in Trademark Image (If Applicable)
If the trademark image includes a date (Hijri or Gregorian), legal documentation is required to confirm its authenticity.
6. Priority Claim for Foreign Filings (If Applicable)
If the trademark was filed in another country within the past six months, the following must be submitted:
A priority certificate issued by the foreign authority showing the initial filing date.
A copy of the previous application and its certified Arabic translation.
These documents must be submitted within six months from the Saudi filing date.
7. Verification of Academic Titles (If Applicable)
If the trademark image includes academic titles (e.g., Dr., Prof.), official documents proving the right to use such titles must be included.
Note: Additional documentation may be required for non-Saudi individuals or foreign entities.
8. Consent for Names, Photos, or Emblems (If Applicable)
If the trademark includes personal names, photographs, nicknames, or logos, the applicant must obtain and submit written consent from the concerned person or entity.
9. Proof for Family Names (If Applicable)
If the trademark contains a family name, you must submit verification documents such as the commercial registration or national ID.
Note: For foreign applicants, additional requirements may apply.
10. Re-Registration After Expiry
If the trademark had previously expired and is being re-registered under a different or amended commercial registration, the original registration certificate must be attached.
11. Power of Attorney
If the trademark owner is not a Saudi citizen, nor a legal resident in Saudi Arabia, nor a company registered in Saudi Arabia, then the trademark must be filed through an official Trademark Agent authorized by SAIP. In this case, the trademark owner must issue a Power of Attorney (PoA) that specifically authorizes the agent to act on their behalf in all matters related to the trademark registration, with the PoA meeting all formal requirements set by SAIP.
12. Selection of Trademark Classes
The trademark owner must identify and select the appropriate class or classes under the Nice Classification system.
13. List of Goods and Services
The applicant must prepare a detailed list of the goods and/or services that the trademark will cover under the selected class.
